Acceptance of Terms

By creating an account or using the EngageFabric platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including individuals and organizations.

Account Terms

  • You must be at least 18 years old to use the Service.
  • You must provide accurate, complete, and current information when creating your account.
  • Each account is for a single organization. Creating multiple accounts to circumvent usage limits is prohibited.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • Notify us immediately at support@engagefabric.com if you suspect unauthorized access to your account.

Alpha Program Terms

During the alpha phase of the Service:

  • Alpha access is provided free of charge.
  • Features, APIs, and interfaces may change, be added, or be removed without prior notice.
  • No Service Level Agreement (SLA) applies during alpha. We provide best-effort availability.
  • We reserve the right to limit or revoke alpha access at any time, for any reason.
  • Alpha participants are expected to provide feedback via monthly calls (30 minutes) as a condition of continued access.

Acceptable Use

You agree not to:

  • Abuse, overload, or attempt to disrupt the Service.
  • Reverse engineer, decompile, or create derivative works based on the Service.
  • Use the Service to build a competing gamification platform or scrape its data for competitive purposes.
  • Inject malicious, harmful, or illegal content through gamification events or player data.
  • Violate applicable laws or regulations in your use of the Service.
  • Share, sell, or transfer your account access to third parties without our written consent.

API Usage

  • API usage is subject to rate limits defined by your subscription plan.
  • API keys are confidential credentials. You must not expose them publicly (e.g., in client-side code, public repositories, or documentation).
  • If an API key is compromised, revoke it immediately and generate a new one from the admin console.
  • Automated abuse or intentional circumvention of rate limits is prohibited.

Intellectual Property

EngageFabric retains all intellectual property rights to the Service, including the platform, codebase, APIs, documentation, and branding.

You retain all intellectual property rights to your content and your end users' data. By using the Service, you grant EngageFabric a limited, non-exclusive license to process your data solely to provide the Service.

Data Processing

Your use of EngageFabric involves processing data about your end users ("Players"). In this relationship, you are the data controller and EngageFabric is the data processor. You are responsible for ensuring you have the appropriate legal basis to process your end users' data.

Service Availability

We provide the Service on a best-effort basis. During the alpha phase, no formal uptime SLA applies. We will communicate planned maintenance and major outages via email and our status page. We are not liable for losses or damages resulting from service downtime.

Limitation of Liability

To the maximum extent permitted by applicable law, EngageFabric and its founders, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, or loss of business opportunities, arising from your use of or inability to use the Service. Our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the amounts paid by you to EngageFabric in the twelve months preceding the claim.

Termination

  • Either party may terminate the service relationship at any time with reasonable notice.
  • You may export your data at any time from the admin console. After termination, data export is available for 30 days, after which data is permanently deleted.
  • We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

Changes to Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice via email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the jurisdiction of the company's registered address. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction.
